Terms of Service

These Terms govern access to and use of Gleshén services, including Flingpalm (the publishing and distribution hub), and any related websites, tools, and communications. By using the Services, you agree to these Terms.

Introduction

Company: Gleshén (Controller: Gleshenco UG (haftungsbeschränkt)) (“Company”, “we”, “us”).
Services: Our websites and products, including Flingpalm, and any related features such as publishing, discovery, promotion, distribution, and partner communications (“Services”).
You: Any visitor, creator, studio, partner, or customer using the Services (“you”, “your”).

If you do not agree to these Terms, do not access or use the Services. Additional terms may apply to specific features, plans, or partner agreements. If there is a conflict, the specific agreement controls for that subject matter.

Age and Eligibility

  • The Services are intended for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Services.
  • You represent that your use of the Services is lawful where you live and where you access them.
  • We may restrict or refuse service to anyone at any time where permitted by law, including to protect the community or comply with legal obligations.

Temporary Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or business use, strictly in accordance with these Terms and any posted rules.

This license does not include any right to resell the Services, scrape the platform, reverse engineer, or use the Services in a way that harms or disrupts the community.

Your Content

“Your Content” means any text, images, videos, links, or other material you upload, publish, or otherwise submit through the Services.

  • You own Your Content (or you have the rights to use it). You are responsible for ensuring you have all necessary rights, permissions, and consents.
  • You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, perform, distribute, and otherwise use Your Content solely to operate, promote, and improve the Services and to provide distribution and discovery functionality.
  • You understand that distribution features may display Your Content in feeds, categories, previews, or other placements.
  • We may remove or restrict Content at our discretion (including to enforce policy, comply with law, or protect users).

Hobby Plan

If we offer a “Hobby” or free/entry plan, it is intended for light usage and evaluation. The Company may apply limits (such as storage, posting frequency, visibility, or features) to prevent abuse and protect service quality.

Plan details and limits are defined on the relevant pricing or product pages, and may change over time.

Acceptable Use

You agree not to use the Services to engage in prohibited activity. This includes (without limitation):

  • No illegal content or unlawful activity.
  • No minors (no content depicting or involving minors, and no attempt to exploit or endanger minors).
  • No non-consensual content, including “revenge” content, coercion, threats, blackmail, or extortion.
  • No harassment, hate, targeted abuse, or doxxing.
  • No spam, fake engagement, or manipulation (including bots or deceptive practices).
  • No hacking, malware, unauthorized access, or interference with systems or accounts.
  • No scraping or automated collection of data without our written permission.

We may enforce these rules through removal, restriction, suspension, termination, reporting to relevant parties, or other actions as appropriate.

Etiquette

  • Be respectful and communicate in good faith.
  • Don’t impersonate others or misrepresent affiliation or ownership.
  • Keep promotions truthful and avoid deceptive claims about services, earnings, or results.

Security and Compliance

You agree to use reasonable measures to secure your account and devices. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

General

We may update, change, suspend, or discontinue parts of the Services at any time. We may add or remove features, including partner programs and distribution methods, to improve performance and safety.

PCI Compliance

The Services are not designed for you to submit, store, or process payment card data within user-generated content or messages. Where payments are offered, payment processing is handled by a payment provider (e.g., Stripe) under their terms.

HIPAA Compliance

The Services are not designed to process Protected Health Information (PHI) under HIPAA. Do not upload or submit PHI through the Services unless we have explicitly agreed in writing to a HIPAA-compliant arrangement.

Data Protection

Our processing of personal data is described in our Privacy Policy. By using the Services, you understand that we process data to operate and secure the Services, and to provide distribution and discovery features.

International Transfers of Data

Depending on providers and infrastructure, data may be processed outside your country, including outside the EU/EEA. Where required, we rely on appropriate safeguards as described in the Privacy Policy.

Use of Your Data

We use data to operate the Services, enforce policy, prevent abuse, provide support, and improve performance. We may use basic signals (e.g., clicks, views) to evaluate distribution outcomes.

Aggregate Data

We may create aggregated or de-identified data sets for analytics and service improvement. Aggregated/de-identified data is not intended to identify you personally.

Usage Restrictions

  • No reverse engineering or attempting to extract source code.
  • No circumventing feature limits or access controls.
  • No using the Services to compete by copying our product or presentation.
  • No using our brand assets without permission.

Electronic Communications

By using the Services or contacting us electronically, you consent to receiving communications electronically (e.g., email), and agree that such communications satisfy legal requirements for written notice where permitted.

Representation and Warranties

Representations

  • You represent that you have the legal right to enter into these Terms.
  • You represent that Your Content does not violate law or third party rights, and that all necessary consents are obtained.

Mutual Warranty

Each party warrants that it has the authority to enter into these Terms. Except as expressly stated, the Services are provided “as is” and “as available.”

Indemnification

You agree to indemnify and hold the Company harmless from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, Your Content, or your violation of these Terms, to the extent permitted by law.

Confidentiality; Proprietary Rights

Confidentiality

If you receive non-public information from us (e.g., partner terms, pricing, or operational details), you agree to keep it confidential unless disclosure is required by law.

Company Ownership

The Services, including their look and feel, features, and underlying IP, are owned by the Company or its licensors. Except for the limited license granted to you, no rights are granted.

Feedback

If you provide feedback or suggestions, you grant us a non-exclusive, worldwide, royalty-free right to use it without restriction or compensation.

Customer Name

We may reference you as a customer/partner only with consent, or as otherwise permitted by a separate written agreement.

Payment of Fees

Plans

Certain features, partner programs, or services may require a paid plan or fees. Plan details are shown on the relevant pages or in a separate agreement.

Payments

If payments are enabled, you agree to pay applicable fees and taxes. Payment processing may be handled by a third-party provider (e.g., Stripe) under their terms.

We may suspend access for non-payment, chargebacks, or suspected fraud as permitted by law.

Term and Termination

Term

These Terms apply while you access or use the Services.

Survival

Sections that by their nature should survive termination (e.g., ownership, disclaimers, limitations, and dispute terms) will survive.

Effect of Termination

We may suspend or terminate access at any time for violations, safety, or legal compliance. Upon termination, your right to use the Services ends, and we may remove or restrict content and access as appropriate.

Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

Limit of Liability and Waiver of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICES IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM (OR €100 IF YOU PAID NOTHING), UNLESS A DIFFERENT LIMIT IS REQUIRED BY LAW.

Nothing in these Terms limits liability where it cannot be limited under applicable law (e.g., intent, gross negligence, or mandatory consumer protections, where applicable).

Miscellaneous

  • Severability: If a provision is unenforceable, the rest remains effective.
  • Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or successor.
  • Changes: We may update these Terms and will update the “Last updated” date.

Governing Law; Disputes; Arbitration

Law

These Terms are governed by the laws of Germany, excluding conflict of law rules, unless mandatory law in your jurisdiction requires otherwise.

Binding Contract

These Terms form a binding agreement between you and the Company when you access or use the Services.

Exclusive Jurisdiction and Venue; Arbitration

Where permitted, disputes will be handled by the competent courts in Germany. If a separate agreement with you includes arbitration terms, that agreement controls.

Disputes with a Domestic Customer

If you are located in Germany, consumer protections may apply. We encourage you to contact us first to resolve concerns.

Disputes with a Foreign Customer

If you are outside Germany, local mandatory laws may apply to you. To the extent permitted, disputes will be handled under the Law section above.

Opt-Out

If an arbitration opt-out is offered under a separate agreement, the opt-out process and timeline will be described there.

Previews

The Services may generate or display previews (e.g., thumbnails, snippets, short clips) to support discovery and distribution. You authorize the creation and display of such previews as part of the Services.

Schedule I

Schedule I may include plan details, partner-specific terms, posting standards, content policy references, or distribution rules. Where posted, Schedule I is incorporated by reference.
